These Terms of Service (“Terms”) are an agreement between you and PWNSware LLC(“PWNSware”, “we”) covering your use of the TallyCAT mobile app and any related services. By installing or using TallyCAT, you agree to these Terms. If you don’t agree, don’t use the app.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use TallyCAT on Apple devices you own or control, subject to these Terms and the Apple Media Services Terms. You may not copy, modify, reverse engineer, or redistribute the app except as permitted by law.

Acceptable Use

Use TallyCAT only for lawful, personal, non-commercial purposes related to tracking AKC Fast CAT activity. Do not use the app to harass others, infringe intellectual property, attempt to bypass technical limits, or scrape or resell data the app exposes.

Your Data

TallyCATstores your dogs, runs, events, photos, and settings locally on your device and in your own private iCloud account. We do not host that data on our servers. You retain all rights to it. Backup, export, and deletion are entirely under your control — see the Privacy Policy for details.

TallyCATPro & Subscriptions

Some features (such as unlimited dogs, unlimited slip scanning, CSV export, photos, and detailed run metadata) are gated behind TallyCAT Pro. Pro is offered as:

Monthly subscription — $2.99 / month, with a 7-day free trial for new subscribers
Annual subscription — $19.99 / year
Lifetime purchase — $39.99 one-time

Auto-renewal: Monthly and annual subscriptions automatically renew at the listed price unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within that 24-hour window. You can manage and cancel subscriptions in your iOS Settings → [your name] → Subscriptions.

Free trial: any unused portion of a free trial is forfeited when you purchase Pro before the trial ends.

Refunds: all purchases are processed by Apple under their refund policies. PWNSware cannot issue refunds directly. Request refunds at reportaproblem.apple.com.

Pricing is subject to change. We’ll give existing subscribers reasonable advance notice of any price increase affecting their subscription.

AKC and Third-Party Content

TallyCAT is not affiliated with, endorsed by, or sponsored by the American Kennel Club (AKC). The names “AKC” and “Fast CAT”, breed names, and ranking data referenced in the app belong to their respective owners. The app retrieves publicly available data from AKC’s websites on your behalf for informational purposes. AKC may change, restrict, or remove that data at any time, and features depending on it may stop working without notice.

Intellectual Property

TallyCAT’s code, design, brand, and original content are owned by PWNSware LLC and protected by copyright, trademark, and other laws. These Terms do not transfer any of those rights to you.

Disclaimers

TallyCATis provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Stats, projections, AKC rank lookups, and AI-generated content are best-effort and may be incomplete or wrong; do not treat them as the official record. The official record of Fast CAT runs and titles is whatever the AKC publishes.

Limitation of Liability

To the fullest extent permitted by law, PWNSware will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of your use of (or inability to use) TallyCAT. Our total liability for any claim relating to the app will not exceed the amount you paid PWNSware for the app in the twelve (12) months before the claim, or USD$50, whichever is greater.

Termination

You may stop using the app at any time by deleting it. We may suspend or terminate access if you violate these Terms. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

Changes

We may update these Terms from time to time. The effective date at the top reflects the most recent revision. Material changes will be surfaced in the app. Continued use after changes take effect constitutes acceptance.

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction for intellectual- property claims.

Apple End-User License

You acknowledge that these Terms are between you and PWNSware LLC, not Apple. Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
