Terms of Service

Welcome to TallyCAT. By downloading, installing, or using the TallyCATmobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Use of the App

TallyCAT is provided by PWNSware LLCto help you track your dogs' Fast CAT runs and related statistics. You may use the App for personal, non-commercial purposes in accordance with these Terms.

2. Subscriptions and Payments

Some features of TallyCATrequire a paid subscription ("Pro"). Subscriptions are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your device's Settings under Subscriptions.
  • Refunds are handled by Apple according to their refund policies.

3. User Content

You retain ownership of all content you create in the App (dog profiles, run data, photos). You are responsible for ensuring you have the right to use any content you add to the App.

4. AKC Data

TallyCAT displays publicly available information from the American Kennel Club (AKC) for verification and leaderboard purposes. AKC data is provided "as is" and may not always be current. TallyCAT is not affiliated with, endorsed by, or sponsored by the AKC.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PWNSWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

7. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

8. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
